Terms of Use
1. Agreement to these terms
These Terms of Use (“Terms”) are an agreement between you and Faza Works LLC, a Nebraska limited liability company (“Faza Works,” “we,” “us,” or “our”), which operates Spenditure. They apply to the Spenditure app at app.getspenditure.com, this website, and related emails and integrations (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. Who can use Spenditure
You must be at least 18 years old and able to form a binding contract to create an account. You can use the Service only for your personal or household planning, and only in compliance with applicable law.
3. What Spenditure is — and isn't
Spenditure is an informational planning tool. It uses the information you enter to estimate things like paycheck pressure, safe to spend, and savings targets.
- Not advice. Spenditure doesn't provide financial, investment, tax, legal, accounting, or credit advice. Budget methods and insights are general information. Consider talking to a qualified professional before making financial decisions.
- Your numbers, your responsibility. Results are only as accurate as what you enter. Always check real due dates, amounts, and balances with your bank and billers.
- We don't move money. Spenditure doesn't pay bills, transfer funds, or connect to your bank. Reminders are a convenience and may be delayed or not delivered, so don't rely on them alone to avoid late fees.
4. Your account
- Give accurate information and keep it up to date.
- Keep your password and any API or MCP tokens secret. You're responsible for activity on your account, including actions taken by tools you connect with your tokens.
- Tell us right away at support@getspenditure.com if you think your account has been accessed without permission.
- Accounts are for one person. Don't share your login — on Family, invite your partner instead.
5. Plans, billing, and cancellation
- Free plan. The Free plan is free with the limits shown on our pricing page, which may change.
- Paid plans. Pro and Family are billed monthly in advance through Stripe and renew automatically each month until you cancel. By subscribing, you authorize us (through Stripe) to charge your payment method each month.
- Canceling. You can cancel any time from Manage billing in the app. Your paid features continue until the end of the current billing period, and then your account moves to the Free plan.
- Refunds. Except where required by law, payments are non-refundable and we don't give refunds or credits for partial months.
- Price changes. We may change prices. We'll tell you at least 30 days before a change affects you, and it will apply from your next billing period. You can cancel before then.
- Taxes and failed payments. Prices don't include taxes, which may be added where required. If a payment fails, we may move your account to the Free plan.
- Downgrades. Moving to a lower plan doesn't delete your data, but features and limits of the lower plan apply.
6. Households and family members
- On the Family plan, the household owner can invite one other adult. Items marked as shared, and household totals, are visible to both adults.
- Only add information about other people, such as a partner or children, if you have the right to do so. A parent or legal guardian is responsible for any child profile they create.
- If a member leaves or is removed, their shared items become personal to the person who created them.
7. Your content
You own the information you put into Spenditure (“Your Content”). You give us a limited, worldwide, non-exclusive license to host, store, copy, process, and display Your Content only as needed to provide, secure, and improve the Service for you, and as described in our Privacy Policy. This license ends when you delete Your Content or your account, except for copies kept in backups or as required by law.
If you send us feedback or ideas, we may use them without any obligation to you.
8. Acceptable use
Don't:
- break the law, or use the Service to defraud or harm anyone;
- access another person's account or data without permission;
- probe, scan, or test the Service's security, or interfere with or overload it;
- scrape the Service, or use it in a way that exceeds reasonable API limits;
- copy, resell, or reverse engineer the Service, except as the law allows;
- upload malware, or content that is unlawful, abusive, or infringes someone else's rights.
9. Integrations and third-party services
The Service can work with third-party services such as Google, Telegram, Stripe, and AI assistants you connect through MCP or our API. Your use of those services is governed by their own terms and privacy policies. We aren't responsible for third-party services, and we may change or discontinue an integration if the third party changes or ends access.
10. Our intellectual property
The Service — including its software, design, text, and the Spenditure name and logo — belongs to Faza Works and its licensors. These Terms give you a personal, non-transferable right to use the Service; they don't give you any other rights in it.
11. Changes to the Service
We're always improving Spenditure. We may add, change, or remove features. If we remove a major paid feature, or stop offering the Service, we'll give you reasonable notice and, where possible, a way to get a copy of your data.
12. Ending your account
You can delete your account at any time from Settings in the app. We may suspend or close your account if you seriously or repeatedly break these Terms, if required by law, or to protect the Service or others. Where reasonable, we'll tell you first and give you a chance to fix the problem or export your data. Sections that by their nature should survive — including 7, 13, 14, 15, and 16 — survive after your account ends.
13. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Faza Works disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise that the Service will be uninterrupted, error-free, or secure, that reminders will be delivered on time, or that any estimate or insight is correct or suitable for you.
14. Limitation of liability
To the fullest extent permitted by law, Faza Works and its members, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, late fees, penalties, overdraft charges, or lost data, arising from or related to the Service, even if we were told they were possible.
Our total liability for all claims related to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) $50.
Some places don't allow some of these limits, so they may not all apply to you. Nothing in these Terms limits liability that can't be limited by law.
15. Indemnity
If you use the Service in breach of these Terms or the law, and that leads to a claim against Faza Works, you agree to cover our reasonable losses and costs, including reasonable attorneys' fees, to the extent allowed by law.
16. Governing law and disputes
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law rules. Before filing a claim, please email us so we can try to resolve it informally. If we can't, any legal action must be brought in the state or federal courts located in Douglas County, Nebraska, and you and we consent to those courts' jurisdiction. Either of us may bring a qualifying claim in small claims court. If you live outside the United States, you may also have rights under your local consumer laws that these Terms can't override.
17. Changes to these Terms
We may update these Terms. If a change is material, we'll tell you by email or in the app at least 30 days before it takes effect. If you keep using the Service after that, you accept the updated Terms. If you don't agree, you can delete your account before the change takes effect.
18. General
These Terms and the Privacy Policy are the entire agreement between you and Faza Works about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a part right away, we haven't waived it. You can't transfer these Terms without our consent; we may transfer them as part of a merger, sale, or reorganization.
